Terms of Service

1. Scope

These terms govern the use of the everydata.io APIs, website and developer portal (the "Service") provided by Julian Wagner ("we"). By creating an account you accept these terms.

2. Account and API keys

You must provide a valid e-mail address. API keys are personal to your account; keep them confidential and do not share them with third parties. You are responsible for all requests made with your keys.

3. Plans, fees and payment

Paid plans are billed monthly in advance. The monthly request quota and the per-minute rate limit are defined by the selected plan. Fees are stated net of VAT unless indicated otherwise. Payment is due upon invoicing via the payment methods offered in the portal.

4. Quota and overage

When the monthly quota is exhausted, further requests are rejected with HTTP 429 until the next billing period. There is no automatic overage billing. Requests that fail due to errors on our side or on the target website are not counted.

5. Cancellation and refunds

You may cancel or change your plan at any time in the portal. Cancellation takes effect at the end of the current billing period. Fees already paid are not refunded, except where required by law.

6. Acceptable use

• Use the Service only for lawful purposes and in compliance with applicable data-protection law.
• Do not attempt to circumvent rate limits, quotas or security measures.
• Do not resell raw API access without our written consent.

7. Availability

We aim for high availability but do not guarantee uninterrupted operation. Target websites may change without notice, which can temporarily affect individual endpoints. We will use reasonable efforts to restore functionality quickly.

8. Liability

The Service is provided "as is". To the extent permitted by law, our liability is limited to the fees paid by you in the twelve months preceding the claim, except in cases of intent or gross negligence.

9. Changes

We may update these terms with at least 30 days' notice by e-mail. Continued use after the effective date constitutes acceptance.

10. Governing law

These terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction for merchants is our registered seat.
